Co-operative Insurance Companies v. Denise Woodward, James Bennett, Individually, and as Administrator for the Estate of Brooke Bennett, Vermont Supreme Court No. 11-158, 2012 VT 22, 191 Vt. 348, 45 A.3d 89. The firm represented Cooperative Insurance Companies in this declaratory judgment action seeking a declaration that the homeowners insurance policy issued to Denise Woodward did not provide coverage for a negligent supervision claim brought against Ms. Woodward by James Bennett, whose daughter had allegedly been killed by Ms. Woodward’s then-husband.

At the trial court level, the firm successfully obtained summary judgment on behalf of the carrier. The firm handled the appeal, and the Vermont Supreme Court affirmed the trial court’s decision. Wadhams and Robin Ober Cooley handled the defense of the case, and Ms. Cooley successfully briefed and argued the appeal.
