Del Monaco et al. v. Green et al., Docket No. 1:08-cv-63-jgm. The firm represented Defendant James Green, a contractor who had constructed a deck and installed a fire pit for Plaintiff Amadeo Del Monaco in 2006 at Mr. Del Monaco’s vacation home in Wallingford, Vermont. On the night of December 28, 2006, after Mr. Del Monaco used the fire pit, the home caught fire, and caused significant damage. Suit was commenced on March 5, 2008, in Rutland County Superior Court. The firm removed the case to federal court, and the firm successfully obtained dismissal of many of the claims prior to trial. After a four-day jury trial, the jury returned a defendant’s verdict on August 4, 2009.

Plaintiff appealed, and the Second Circuit Court of Appeals affirmed all but one of the trial court’s pretrial rulings, remanding the case for a second trial. After a four-day jury trial on Plaintiff’s breach of contract claim, the jury returned another defendant’s verdict on February 3, 2012.
